Refund policy
Art. 7 Right of Withdrawal of the General Terms and Conditions of Sale
7.1 Users are kindly requested to review this article with particular attention, as it governs the right of withdrawal.
7.2 The right of withdrawal is the Consumer’s right to terminate the purchase contract without being required to provide any reason. If you have purchased as a Professional, the right of withdrawal does not apply, unless otherwise agreed with the Seller. Any exceptions to the right of withdrawal are set out in this Article 7. If there are no exceptions to the right of withdrawal, this Article 7 shall apply in full.

Customised or Personalised Goods: Tailor-made or clearly personalised goods are sold on the Site. If you act as a Consumer, the following rules on the right of withdrawal do not apply by specific provision of law. Indeed, were this not the case, the Seller would be unable to resell a Product made specifically for you.

Sealed Goods: Sealed goods that are not suitable for return for hygiene or health protection reasons are sold on the Site. If these Goods have been unsealed after delivery, you lose the right of withdrawal. Therefore, the following rules on the right of withdrawal do not apply.

Perishable Goods: The Products sold on the Site are liable to deteriorate or expire rapidly. For this reason, the rules on the right of withdrawal do not apply, given that, otherwise, the Seller would be unable to resell Products that are no longer usable by buyers.
7.3 If you act as a Consumer (and provided that no exceptions set forth in this article apply), you have the right to withdraw from the purchase contract for the Product without giving any reason and without incurring costs other than those provided for in this article, within a period of fourteen calendar days (Withdrawal Period). The Withdrawal Period expires after 14 days:

in the case of an order for a single Product, from the day on which you or a third party, other than the carrier and designated by you, acquires physical possession of the Products;

in the case of a Multiple Order with separate deliveries, from the day on which you or a third party, other than the carrier and designated by you, acquires physical possession of the last Product; or
-
in the case of an order relating to the delivery of a Product consisting of multiple lots or pieces, from the day on which you or a third party, other than the carrier and designated by you, acquires physical possession of the last lot or piece.

7.4 To exercise the right of withdrawal, you must inform the Seller, before the expiry of the Withdrawal Period, of your decision to withdraw. To this end, you may write to the Seller at the following email address ecommerce@emporioenologico.com, or use the form available on the Site.
You have exercised your right of withdrawal within the Withdrawal Period if the communication concerning the exercise of the right of withdrawal is sent by you before the expiry of the Withdrawal Period.
7.5 Unless otherwise agreed, the direct costs of returning the Products shall be borne by the Consumer, as shall the liability for their transport. In the event of exercise of the right of withdrawal, the Product must be sent to the Seller's registered office:

7.6 Where the withdrawal is applicable, the Seller shall refund the Total Amount Due, including delivery costs, if applicable, without undue delay and in any case no later than 14 calendar days from the day on which the Seller was informed of the decision to withdraw from the contract. The refund will be carried out using the same payment method used for the initial transaction, unless otherwise agreed between you and the Seller. In the event that the Products were dispatched using a carrier chosen by the Consumer and at the latter's expense, the Seller may withhold the refund until receipt of the Products or until the Consumer has supplied proof of having sent back the Products, whichever is earlier.
7.7 The Consumer is solely liable for any diminished value of the goods resulting from the handling of the Product other than what is necessary to establish the nature, characteristics, and functioning of the Product. In any case, the Product must be kept, handled, and inspected with ordinary diligence and returned intact, complete in all its parts, fully functioning, accompanied by all accessories and instruction leaflets, with identification tags, labels, and the disposable seal—where present—still attached to the Product, intact, and untampered with, as well as perfectly fit for its intended use and free from signs of wear or dirt. Furthermore, withdrawal applies to the Product in its entirety. It cannot, therefore, be exercised in relation to parts and/or accessories of the Product.
7.8 In the event that the Product for which the withdrawal was exercised has suffered a reduction in value resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the Product, the Seller reserves the right to deduct an amount equal to such reduction in value from the refund amount. The Seller shall give notice of this circumstance and the resulting reduced refund amount, providing, in the event that the refund has already been paid, the bank details for the payment of the amount due by the user as a result of the reduction in value of the Product. In the event that the withdrawal has not been exercised in accordance with applicable legislation, it shall not result in the termination of the contract and, consequently, shall not entitle the user to any refund.
7.9 This article governs a very important area concerning return costs in the event of withdrawal. In light of the above, the Seller deems it appropriate to highlight that the costs of returning the Product shall be at your expense and under your responsibility.
The Products must be returned to the address indicated in the "Seller’s Details" section in the Preamble or to the address communicated from time to time by the Seller.
7.10 Without prejudice to the right of withdrawal, where available, and the rights provided for by the legal guarantee of conformity, the customer may always request the replacement of the Product. It is at the Seller's sole discretion to accept this request. The costs of returning the Product subject to return and those for shipping the new Product shall be borne by the customer, unless otherwise agreed with the Seller. Irrespective of the legislation in force in the destination countries, the right of withdrawal and any exclusion thereof shall be governed by the provisions of the preceding articles, also with reference to customers residing in non-EU countries.
